Yardly is operated by J.A.Y Developments ("we", "us", "our"). Yardly is an online service that lets people across Canada post garage sales on a map and lets shoppers find them. By using Yardly, you are contracting with J.A.Y Developments and you agree to these Terms & Conditions. If you do not agree, please do not use the service.
Yardly provides a platform for advertising garage, yard and estate sales ("listings") and for browsing those listings on a map. We are not a party to any sale: items are sold by the person hosting the garage sale, and any purchase is strictly between buyer and seller. We do not inspect, own, or guarantee any listed item.
You must be of legal age in your province or territory, or have a parent or guardian's permission, to create an account. You are responsible for keeping your account credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.
Browsing Yardly is free. Posting a garage-sale listing costs a one-time fee of $10.00 CAD per listing, charged at the moment you submit the listing. A listing appears publicly only after payment is completed.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax and cancellation mechanics are governed by Paddle's Buyer Terms. Refunds are handled under our Refund Policy.
You must not misuse Yardly. In particular, you must not:
You are responsible for your listings and photos, for how your sale is run, and for ensuring you have the rights to any content you upload. You grant us a limited licence to host and display that content solely to operate the service.
J.A.Y Developments retains all ownership of Yardly and its intellectual property, including the software, design, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service for its intended purpose. You may not reverse engineer, resell, redistribute, or circumvent technical limits of the service.
We work hard to keep Yardly available, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and "as available", and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law.
To the fullest extent permitted by law, J.A.Y Developments is not liable for indirect, consequential or special damages (including loss of profits, data or goodwill) arising from your use of Yardly, and our aggregate liability is capped at the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability for fraud, death or personal injury where the law does not allow it. You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
We may suspend or terminate your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious violations of our policies. When access ends, your listings are removed from public view; you may contact us within 30 days to request an export of your content, after which it may be deleted.
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada, and disputes will be heard in the courts of Alberta. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control. If any clause is unenforceable, the rest of these terms remain in effect.
